Privacy Policy
(Articles 8º, 13º, 14º and 21º of the General Data Protection Regulation - RGPD)
The controller of personal data processing, Syst-MP, Lda, is a limited liability company with the social object categorized as retail trade, represented by Paulo Homem, with the email address paulohomem@syst-mp.com.
The processing of personal data by Syst-MP, Lda complies with Regulation (EU) 2016/679 of 27 April 2016 concerning the protection of individuals with regard to the processing of personal data and to the free movement of such data.
The data collected will be used for the purpose for which they were collected and for which they have been authorised by the data subject. The data may also be used, with the express consent of the holders, for contacts with information related to the reason for processing the data.
When filling in forms, the communication of personal data is optional, free and voluntary.
However, on certain forms, information marked with an * is compulsory. Failure to provide information marked as mandatory will result in the impossibility of analysing the information for the purposes of filling in the form and consequently the impossibility of providing the information or services requested, since it makes communication unfeasible.
In the provision of services and the offer of products, Syst-MP, Lda processes various categories of customers and non-customers holders of personal data, having classified them as follow:

Civil identification data (vg. name, gender, date of birth, signature);

Fiscal identification data (vg. fiscal identification number);

Digital identification data (vg. IP address, geographic coordinates);

Other identifying data (vg. father's name, mother's name, social media);

Address and contact details (vg. tax address, correspondence address);
Professional data and academic qualifications (vg. profession, employer, income, public positions, individual entrepreneur);
Syst-MP, Lda processes the personal data of any data subject under any of the following purposes:

Execution of contracts entered into or performance of pre-contractual diligences at the request of the Holder of the personal data;

Fulfilment of legal obligations to which Syst-MP, Lda is bound;

Pursuit of the legitimate interests of Syst-MP, Lda;
All other situations not falling within the above-mentioned purposes require the consent of the holder, which must be given freely, specifically, informed and unequivocally.
To comply with its duties and to provide a quality service, Syst-MP, Lda may have to communicate your personal data to other entities, including the following categories of recipients: Tax Authority, Service Providers.
When filling out and sending forms, in addition to the information requested in the form regarding name, email contact and mobile phone, the system records the IP, date, time and communication service provider, browser and equipment.

The processing of data by Syst-MP, Lda will continue for as long as necessary or obligatory for the fulfilment of the above-mentioned purposes. Upon termination of the contractual relationship, the personal data, the processing of personal data and the related data storage shall be maintained for the mandatory legal time limits or until the rights arising therefrom have expired in accordance with the law.
Under the terms of the applicable law, Customers, as holders of data, are entitled to the following rights:

Right of access: whenever they so request, they may access their personal data, obtain information relating to the processing of their data and, furthermore, obtain a copy of their personal data undergoing processing.

Right of rectification: whenever you consider your personal data to be incomplete or incorrect, you may request the rectification or completion.

Right to erasure: without prejudice to legal and regulatory obligations which may limit the exercise of this right, you may request the erasure of your personal data when one of the following situations arises: (i) the personal data are no longer necessary for the purpose that motivated their collection or processing; (ii) you withdraw the consent on which the data processing is based and there is no other legal ground for it; (iii) you object to the processing of the data and there are no overriding legitimate interests, to be assessed on a case-by-case basis, that justify the processing; (iv) the personal data must be erased under a legal obligation to which Syst-MP, Lda is subject; (v) the personal data have been unlawfully processed; or (vi) the personal data have been collected in connection with the provision of information society services. The right to erasure shall not apply to the extent that processing is necessary (i) for the exercise of freedom of expression and information; (ii) for reasons of public interest in the area of public health; (iv) for achiving in the public interest, scientific or historical research or statistical purposes to the extent that exercising the right to erasure would serously prejudice the achievement of the purposes of such processing; or (v) for the establishment, exercise or defence of legal claims.

Right to restriction of processing; you may request restriction of the processing of your personal data in the following cases: (i) if you contest the accuracy of your personal data, for a period of time that allows their accuracy to be verified; (ii) if the processing is unlawful and you object to the erasure of the data, requesting, in return, the limitaton of their use; (iii) if the Syst-MP, Lda no longer needs the personal data for the purposes of the processing, but the data are necessary for the establishment, exercise or defence of legal claims; or (iv) if you have objected to the processing until it is established that the legitimate interests of the Syst-MP, Lda override your own.

Right to withdraw your consent: where data processing is carried out on the basis of your consent, you may withdraw your consent at any time. In this case, your personal data will no longer be processed, unless there is another ground that justifies such processing on your part.

Right to lodge complaints with the CNPD: you have the right to lodge complaints regarding matters related to the processing of your personal data with the National Data Protection Commission.
